1.0 Terms of Service

By clicking Buy Now, Purchase, or any other phrase on the purchase button, entering your debit or credit card information, selecting a payment option, or otherwise enrolling electronically, verbally, or in writing, you, the Client, agree to enter into a legally binding agreement with Niamh Flanagan Delaney & Adam Svensson as trustees for the Team Virtual Trust, Team Virtual, and to receive products, programmes, or services subject to the following terms and conditions.



2.0 Refunds and Payment Terms

2.0.1 Refunds

Due to the extensive time, resources, intellectual property, digital materials, coaching, training, and support invested into our programmes, including digital products and e-courses, all sales are final.

We do not offer refunds for any reason, including but not limited to change of mind, change in personal circumstances, financial hardship, lack of participation, relocation, time constraints, change in availability, or perceived lack of results.

By enrolling as a student or client of Team Virtual and/or purchasing any programme, live course, e-course, product, or service, you acknowledge and agree that you are entering into a legally binding commitment for the full programme fee associated with the selected programme, package, term, or payment option.

If you choose to withdraw, reduce participation, stop engaging, defer your start date, or stop attending the programme for any reason, you remain responsible for all remaining payments under your agreed payment plan, selected payment option, and selected programme duration.

Pausing, suspending, delaying, or cancelling scheduled instalment payments is not permitted unless agreed in writing by Team Virtual. All payments must be made on time in accordance with the original agreement until the full agreed sum has been paid.


2.0.2 Commitment & Package Terms

By enrolling in any Team Virtual programme, you agree to the full duration and full fee of the package selected at the time of purchase.

Your selected programme term is a fixed contractual commitment. Downgrading to a shorter programme duration after enrolment is not permitted under any circumstances.

You remain responsible for the full agreed programme fee associated with your selected term, regardless of participation level, usage of materials, attendance at calls, personal circumstances, change in availability, or whether you choose to engage fully with the programme.

If you choose to withdraw, defer, or reduce your level of engagement for any reason, this does not release you from your financial commitment to the full programme term originally selected.

Upgrades to a longer programme duration may be permitted at Team Virtual’s discretion and must be agreed in writing by both parties.



2.0.3 Deferrals

Deferrals may be accepted if agreed by both parties in writing.

All payments must still be made on time according to your original sign-up terms, even if you defer your start date, pause participation, or re-join at a later date.

You can defer and re-join up to 365 days from your original VA Academy start date with no additional re-joining cost.

If you decide to re-join after 365 days from your initial start date, you will be required to pay the difference between your original sign-up amount and the current sign-up amount at the time of re-joining. If there has been no price increase after the 365 days has lapsed, you can re-join with no additional fee.



2.0.4 Deposits and Upfront Payments

When securing your spot via a deposit or upfront payment, this payment forms part of your full agreed programme fee.

A deposit or upfront payment does not reduce, replace, or cancel the remaining balance due unless explicitly stated in writing by Team Virtual.

Your agreed programme price is secured for 365 days from the purchase date. If you decide to sign up, start, or re-join after the initial 365 days has lapsed, the original pricing is no longer secured and you may be subject to the current programme pricing at that time.

If Team Virtual has increased the price of the relevant programme, package, or service after the 365-day period, you may be required to pay the difference between your original agreed amount and the current price.



2.0.5 Exclusive WhatsApp Support

In regards to services that include specifically and only WhatsApp support, please note that unless stated otherwise, these will remain in a group setting.

There may be a minimum or maximum number of people who can enter each WhatsApp group.

Niamh will be inside each WhatsApp group Monday to Thursday giving support. Outside of those days will be days off and response times may vary.

WhatsApp support will be on a monthly subscription basis and you will be billed every 30 days. The monthly cost will remain the same unless an agreed change is made by both parties.

If you choose to cancel, you must provide 7 business days’ notice. If you do not give this notice, you will be required to pay the fee of the upcoming month.

There is no minimum commitment unless stated otherwise, and each subscription is on a month-by-month basis.



2.0.6 Payment Terms

Upon execution of this Agreement, the Client agrees to pay Team Virtual the full purchase amount displayed on the relevant Team Virtual payment checkout, invoice, payment link, written agreement, or payment plan confirmation.

This includes pay-in-full options, payment plan options, Klarna payment options, deposit options, upfront payment options, or any other agreed payment structure.

If the Client selects a payment plan, Klarna, deposit, or upfront payment option, the Client acknowledges and agrees that this is a payment method only and does not change the total programme fee owed.

The full agreed programme fee remains due in full, regardless of whether the Client pays by card, bank transfer, Klarna, deposit, instalments, split payments, or any other payment method made available by Team Virtual.

Where Klarna is selected as a payment method, Klarna’s own terms, conditions, approval process, fees, repayment schedule, and eligibility criteria may also apply. Team Virtual is not responsible for Klarna’s approval decisions, repayment terms, missed Klarna payments, customer credit arrangements, or any fees charged by Klarna.

If Klarna only covers part of the full programme fee, the Client remains responsible for paying the remaining balance directly to Team Virtual according to the agreed payment schedule.

If the Client pays an upfront amount, deposit, partial payment, or Klarna amount towards the programme, this does not cancel or reduce the remaining balance unless explicitly confirmed in writing by Team Virtual.

The Client remains legally responsible for the full agreed programme fee until the full balance has been paid.

If the Client selects a payment plan option, the Client agrees to pay all fees to Team Virtual according to the payment schedule set out at the time of purchase, inside this Agreement, or otherwise provided to the Client in writing.

By agreeing to these Terms, the Client acknowledges that any attempt to initiate a chargeback or payment dispute without first seeking resolution directly with Team Virtual will constitute a breach of contract. The Client remains responsible for any legal, administrative, debt collection, or recovery costs incurred as a result of such wrongful disputes.

In the event of a missed instalment payment, the Client will receive an email notification with a 72-hour grace period.

Team Virtual may suspend programme participation until payment is brought up to date, including restricting access to modules, materials, coaching calls, WhatsApp groups, student platforms, and/or any other programme resources.

If payment is not received within 14 business days, debt collection may be applied by a nomination of Team Virtual’s choice in order for the overdue sum to be settled.



2.0.7 Expectations and Results

All copy, marketing materials, sales pages, emails, testimonials, case studies, call discussions, social media content, and programme descriptions that highlight what to expect, numbers, outcomes, earnings, client wins, or overall results are examples only and are not guarantees or promises.

These examples are based on past or current students and what may be possible when a student takes consistent action, is coachable, shows initiative, and implements the programme material.

It is possible to both exceed and fall short of these examples depending on your work ethic, effort, consistency, circumstances, market conditions, skill level, implementation, and desire to succeed.

Team Virtual does not guarantee income, clients, business growth, specific results, or any particular outcome from joining any programme, product, service, or course.



2.0.8 The VA Academy: Self Study Path

Because this is a self-paced, DIY course, your results will depend on how much effort you put in.

You will have access to the course materials included in your purchase, but it is your responsibility to complete the training, implement the steps, and take action.

The Self Study Path does not include live coaching, individual feedback, WhatsApp support, group calls, or direct access to Team Virtual unless explicitly stated at the time of purchase.



3.0 Recording & Redistribution of Calls

The Client acknowledges that group coaching sessions, live trainings, workshops, and/or group calls may be recorded.

The Client also acknowledges that call recordings may be accessed by members of The VA Academy, including past, current, and future members, depending on the programme structure and access provided.

The Client acknowledges that their first name may be used by Niamh Flanagan Delaney in relation to marketing positive student results on social media platforms, emails, sales pages, websites, or other Team Virtual marketing materials.

If Niamh Flanagan Delaney would like to share screenshots of private conversations that promote positive results and include your name, Niamh will ask the Client for permission first.

If Niamh Flanagan Delaney would like to share your full name while promoting positive results, Niamh will ask the Client for permission first.

The Client agrees not to record, copy, download, share, distribute, sell, reproduce, or repurpose any private coaching calls, programme materials, student conversations, WhatsApp group content, call recordings, or Team Virtual resources without written permission.



4.0 Medical Disclaimer

Please note that the coaching and training services provided are not intended as medical, psychological, or psychiatric advice, and they do not provide diagnosis, treatment, prevention, cure, or guarantee.

The information provided is not a substitute for professional medical, psychological, or psychiatric advice, diagnosis, or treatment tailored to your individual condition and circumstances.



5.0 Legal and Financial Disclaimer

You understand and agree that this website and our coaching programmes, products, services, and/or e-courses are intended for informational and educational purposes only.

The information provided does not constitute financial, legal, tax, accounting, medical, or professional advice.

The Client acknowledges that Team Virtual makes no guarantees regarding income, client acquisition, business growth, employment outcomes, or business results, and accepts full responsibility for their own implementation, decisions, actions, and results arising from participation in any programme, product, service, or course.



6.0 Intellectual Property Protection and Personal Use

The materials on our website, payment pages, student platforms, courses, programmes, products, e-courses, videos, photos, graphics, designs, templates, documents, frameworks, trainings, call recordings, and other files are the proprietary property of Niamh Flanagan Delaney and/or Team Virtual and are protected by Australian intellectual property rights.

You may not share the cost of any product, programme, e-course, training, workshop, or service with any third party.

You may not share, gift, sell, transfer, copy, distribute, or reproduce any Team Virtual product, programme, course, e-course, training, workshop, template, framework, call recording, or resource with any third party.

Sharing your login credentials for any of Team Virtual’s e-courses, programmes, platforms, or resources with any third party is strictly prohibited.

Selling or transferring your access to any masterclasses, trainings, e-courses, workshops, programmes, or the content and/or materials contained therein to any third party is prohibited.

The Client agrees not to publish or communicate any false, misleading, harmful, or defamatory statements about Team Virtual, Niamh Flanagan Delaney, Adam Svensson, Team Virtual Trust, its team members, students, programmes, products, or services.

The Client agrees to raise any concerns directly with Team Virtual in writing and allow a reasonable opportunity for resolution before making any public statements.



7.0 Conduct & Right to Terminate

Team Virtual reserves the right to remove a Client from any programme, group, platform, community, call, student space, or service without refund if the Client’s behaviour is disruptive, abusive, defamatory, inappropriate, harmful, threatening, disrespectful, or in breach of these Terms.

Removal from a programme, group, platform, community, or service due to breach of these Terms does not release the Client from their financial obligations, and all remaining payments under the agreed programme term will remain payable in full.



8.0 Governing Law

This Agreement is governed by and construed in accordance with the laws of Australia, and the parties submit to the exclusive jurisdiction of the courts of Western Australia.
